Great Plains National Bank v. Leppert

IN THE SUPREME COURT STATE OF NORTH DAKOTA

December 15, 2009

GREAT PLAINS NATIONAL BANK, PLAINTIFF AND APPELLEE
v.
SAM LEPPERT, LAURA LEPPERT, DEFENDANTS AND APPELLANTS ANDREW ANTHONY HEINZE, AND J. DOE I-V, DEFENDANTS

Appeal from the District Court of Barnes County, Southeast Judicial District, the Honorable Mikal Simonson, Judge.

Per curiam.

AFFIRMED.

[¶1] Sam and Laura Leppert appealed from an amended judgment in favor of Great Plains National Bank. On appeal, they argue the Bank did not prove standing; the affidavit of the Bank's employee lacked foundation; the Bank did not produce conclusive evidence to support the allegations in its amended complaint; and the Bank is required by law to follow generally accepted accounting principles. We summarily affirm under N.D.R.App.P. 35.1(a)(6).
